1. Acceptance of Terms
ScoutManage is provided as a service to you, subject to the following terms,
which may be updated by us from time to time without notice to you. You may
review the most recent terms at any time at:
ScoutManage is protected by copyright laws and other protections under the
law. It is licensed and not sold. As such, your use of ScoutManage is subject to
2. License Grant
ScoutManage is licensed for your use during the term of service that is
defined by your unit administration, which is determined by the payment paid and package selected.
Only specific features included within the package selected will be included in the license.
Information contained in ScoutManage is available for your use under these terms and during
the term of service. If your term of service expires or is otherwise terminated,
no further access to the information contained in ScoutManage will be required
under this license, and the information may or may not be archived or otherwise
made available for future access. Information contained in ScoutManage includes
unit rosters, membership details, calendar events, member advancement
information, usernames, passwords, and other related information.
3. Restrictions on Use and Access
You must provide your own access to the internet to use ScoutManage. You may
be charged for internet usage by a 3rd party provider, and those charges are
outside the scope of your agreement with ScoutManage.
4. Modifications to Service
ScoutManage reserves the right at any time to modify the service or any
portion of the service with or without prior notice. You agree that ScoutManage
shall not be liable to you or any other party for any modifications of the
5. Loss of Use
If ScoutManage becomes inaccessible for any reason, temporarily or
permanently, or in any other way fails to live up to it's real or perceived
usefulness, ScoutManage will not be liable for any loss you may incur, other
than the reimbursement of any unused paid membership fees. No liability for loss
of data or any other loss shall be provided. In any and all cases, the maximum liability by ScoutManage
shall be less than the current published rate for a 1 year membership, or $100, whichever is less.
6. Data Aging
Some data within ScoutManage ages. This means it's usefulness becomes reduced as time goes on.
Examples of aging data include, but are not limited to, calendar entries and message center messages.
ScoutManage will, as a regular course of business, remove older entries that in our view are no
longer needed. This means, for example, that events that have occurred in the past will be
deleted after a certain period of time, and message center entries that have been around for some time will
The age of an entry upon which it is deleted is at the sole discretion of ScoutManage.
ScoutManage will not be held liable for important
data contained in such entries that is lost. Any important data
within aging entries should be archived by the user. Typically, entries will remain for
at least 30 days after the scheduled event or the date the entry was created. However,
the actual duration may be substantially longer than this, or potentially shorter. We do not
guarantee that the aging interval will stay consistent. ScoutManage
reserves the right to specify the aging interval, and change it without notice or announcement.
Files uploaded to the service are stored on our servers but are not backed up and protected
against accidental or intentional deletion. It is recommended that users retain their own
local copy of any important files. ScoutManage should be used as a mechanism to share such
files, not archive such files.
Files may be deleted accidentally due to system failure, software error, or user error.
Files may be deleted intentionally due to account expiration, account limit changes,
inappropriateness of content, or other such reasons.
7. Appropriateness of Information
ScoutManage reserves the right to monitor messages, event entries, uploaded files, and other data & data fields
for appropriate content. If an entry is deemed to have inappropriate content, ScoutManage reserves
the right to delete such data at it's sole discretion. While ScoutManage will make every attempt
to give the user the chance to modify the offending content, ScoutManage is not obliged to notify the user
nor wait for the user's response before taking action for any reason.
Inappropriate content includes but is not limited to:
information deemed offensive to specific classes of individuals (protected classes or otherwise), information
deemed inappropriate for children, information deemed inappropriate for maintaining the high ideals
of Scouting, information describing illegal or illicit actions, copyrighted or otherwise legal copy restricted
material, virus or malicious content, or other information deemed inappropriate.
While ScoutManage will take appropriate action when inappropriate content is made known,
ScoutManage will not be responsible for policing such data, nor
will it be liable if inappropriate content contained in entries created by any user is not
removed, whether ScoutManage has been informed of the inappropriate information
It is the user's sole responsibility to make sure that content in files that you upload, or download, does not contain
viruses, malware, identity stealing, or other malicious code or content.
It is recommended that all users make use of Anti-Virus and identity controlling software on their computers at all times.
ScoutManage assumes no responsibility for any such content that may appear on our systems.
Publicly viewable files may be viewed by anyone with internet access. This should not be used for any information
your unit does not want viewed by the public. Be especially careful when posting information that contains personally
identifiable information about children. This includes but is not limited to unit rosters and photographs of children
or events where children were present. Please be sure to follow all Pack, Charter Organization, and BSA rules about
what can and can not be made available to the public internet. Be careful when sharing and downloading files.
You agree that ScoutManage, in its sole discretion, may terminate your
account or access to your account for any reason, including, without limitation,
for violation of any real or perceived term in this agreement, whether the
violation is in the letter of the agreement, or in the spirit of the agreement.
ScoutManage may at its sole discretion discontinue providing this service, to
your unit or all units, at any time provided units with active paid accounts are
given 30 days notice and unexpired membership fees are refunded to the unit
administrator within your unit.
9. Disclaimer of Warranties
You expressly understand and agree that use of this service is at your sole
risk. The service is provided "AS IS" and "AS AVAILABLE". ScoutManage makes no
warranties that the service will meet any particular requirement, availability,
No advice or information obtained from anyone by you from ScoutManage or its
representatives shall create any term or warranty not expressly stated in this
10. Limitation of Liability
You expressly understand and agree that ScoutManage shall not be liable for
any direct, indirect, incidental, special, consequential or exemplary damages,
including but not limited to, goodwill, use, data, release of personal information, or other tangible or intangible loses
(even if ScoutManage has been advised of the possibility of such damages),
resulting from the use or inability to use the service, unauthorized access or
alteration of your data and data transmission, or statements or conduct of any
third party on the service.
11. Limitation of Remedies and Damages
Your remedy for a breach of these terms of service by ScoutManage is limited
to a refund of the remaining unused membership fees for ScoutManage service. You
agree to indemnify and hold ScoutManage harmless from all claims, judgments,
liabilities, expenses, or costs arising from your breach of this agreement
and/or acts or omissions.
If any provision of this agreement shall be held to be invalid or
unenforceable, the remainder of this agreement shall remain in full force and
effect. To the extent any express or implied restrictions are not permitted by
applicable laws, these express or implied restrictions shall remain in force and
effect to the maximum extent permitted by such applicable laws.
13. Governing Law and Jurisdiction
ScoutManage is owned and operated by Muskrat Software LLC, a Limited Liability Corporation
licensed in the State of Washington.
ScoutManage is a registered DBA (doing business as) for Muskrat Software LLC.
All references to ScoutManage in this and related documents shall be deemed to apply to
Muskrat Software LLC.
This agreement is governed by the laws of the State of Washington.

Muskrat Software LLC reserves the right to sell or lease full or partial ownership of ScoutManage to any other entity
or entities at it's sole discretion. At the point such a transaction occurs, all agreements, licenses, and
leases with ScoutManage, including this agreement, will be under the control of the new entity or entities
and not Muskrat Software LLC.
All information in this and all other documents and applications constituting ScoutManage are copyrighted
by Muskrat Software LLC.
